By accessing or using our website, placing an online order, submitting a form, making a reservation, or otherwise interacting with services offered through the website, you agree to these Terms.

If you do not agree with these Terms, please do not use the website.

Placing eligible online orders

Contacting the restaurant

Making reservations where available

Reviewing promotions or specials

Accessing restaurant location and hours

Interacting with available restaurant services

You agree not to use the website in any manner that could damage, disable, interfere with, or compromise the website, its security, or another person's use of the website.

You may not attempt to gain unauthorized access to our website, servers, accounts, databases, payment systems, or other systems.

3. Online Orders

Online ordering may be available through our website or through a third-party ordering provider.

By submitting an order, you represent that:

The information you provide is accurate.

You are authorized to use the payment method provided.

You understand the items, quantities, prices, and applicable charges associated with your order.

You are responsible for reviewing your order before submitting it.

An order is not necessarily accepted merely because it was submitted.

We may reject or cancel an order where reasonably necessary, including because of:

Item availability

Incorrect pricing

Technical errors

Duplicate orders

Payment problems

Suspected fraud

Restaurant closure

Kitchen capacity

Safety concerns

Circumstances outside our reasonable control

If an order that has already been paid for is canceled by us and the order is not fulfilled, an appropriate refund will generally be issued to the original payment method, subject to payment processor procedures and applicable law.

4. Order Accuracy

Customers are responsible for reviewing their order before completing checkout.

Please verify:

Menu items

Quantities

Modifications

Pickup or delivery details

Contact information

Special instructions

We will make reasonable efforts to prepare orders according to the information submitted.

We cannot guarantee that changes requested after an order has been submitted can be accommodated.

If you discover an error immediately after submitting an order, contact the restaurant as soon as possible at 801-689-2129.

5. Menu Items and Availability

Menu items are subject to availability.

We may:

Change menu items

Discontinue items

Change ingredients

Adjust portion sizes

Modify preparation methods

Change availability

Add or remove specials

without prior notice where reasonably necessary.

Images displayed on the website are intended to represent our food and restaurant experience. Actual food appearance, presentation, portions, ingredients, and packaging may vary.

6. Pricing

We make reasonable efforts to keep menu prices and other pricing information accurate.

Prices may change from time to time.

The price shown during the applicable ordering process at the time an order is completed generally controls, subject to correction of obvious errors and applicable law.

Taxes, delivery charges, gratuities, service charges, or other applicable charges may be added where disclosed during checkout.

We will not intentionally charge customers for products or services that were not agreed to.

Utah consumer law prohibits deceptive practices in consumer transactions, including misrepresenting price advantages or charging a consumer for a transaction that was not previously agreed to.

7. Pricing and Website Errors

Despite reasonable efforts, the website may occasionally contain:

Incorrect prices

Typographical errors

Incorrect descriptions

Outdated information

Incorrect availability

Technical errors

If an obvious pricing or menu error occurs, we may contact you before fulfilling the order.

If we cannot fulfill an order because of an error, we may cancel the affected item or order and issue an appropriate refund for amounts already paid for goods that will not be provided.

Nothing in these Terms permits Costa Del Sol to engage in deceptive pricing or advertising practices prohibited by applicable law.

8. Food Allergies and Dietary Restrictions

Food allergies and dietary restrictions should be taken seriously.

Our kitchen prepares multiple foods and ingredients in shared areas, and ingredients may come into contact with common allergens.

Cross-contact may occur.

Potential allergens used in our restaurant may include, among others:

Milk

Eggs

Fish

Shellfish

Tree nuts

Peanuts

Wheat

Soy

Sesame

The FDA recognizes nine major food allergens and specifically addresses allergen cross-contact as an important food-safety concern.

If you have a food allergy, sensitivity, or dietary restriction, please notify Costa Del Sol before ordering.

Do not rely solely on website menu descriptions when determining whether a menu item is appropriate for a severe allergy.

We will make reasonable efforts to provide ingredient information and accommodate requests when possible, but because food is prepared in shared facilities, we cannot guarantee that any item is completely free from a particular allergen.

Nothing in this section limits any responsibility imposed on Costa Del Sol by applicable food-safety law.

9. Special Instructions and Modifications

Customers may sometimes be able to request modifications or special instructions.

Submitting a request does not guarantee that we can accommodate it.

Some modifications may:

Cost extra

Affect preparation time

Be unavailable

Be unsuitable for certain menu items

If a requested modification cannot be completed, we may prepare the item according to its standard preparation unless doing so would materially change the order or create a known safety concern.

10. Pickup Orders

Customers placing pickup orders are responsible for:

Providing accurate contact information

Selecting the correct pickup information

Arriving within a reasonable time

Confirming that they received the correct order before leaving when reasonably possible

Estimated pickup times are estimates and may change based on restaurant volume, order size, staffing, equipment, or other circumstances.

11. Delivery Orders

Delivery may be provided by an independent third-party service.

When a third-party delivery provider is used, that provider may be responsible for portions of the delivery process after receiving the order.

Delivery times may vary because of:

Traffic

Weather

Driver availability

Order volume

Distance

Third-party platform operations

Additional terms imposed by the applicable delivery provider may also apply.

12. Cancellations and Refunds

Because food preparation may begin shortly after an order is accepted, online food orders may not always be cancelable after preparation begins.

If you need to cancel an order, contact Costa Del Sol immediately.

Refund eligibility may depend on factors such as:

Whether preparation has started

Whether the order was already completed

Whether an item was unavailable

Whether the order was incorrect

Whether the restaurant canceled the order

Applicable payment processor rules

Applicable law

If there is a problem with your order, contact us promptly so we can review the issue.

Nothing in this policy limits refund or cancellation rights that cannot legally be waived.

13. Payment Processing

Payments may be processed through Wix, an online ordering provider, a payment processor, or another third-party service.

Costa Del Sol may not directly receive or store your complete payment-card information.

Payment providers may apply their own:

Terms

Fraud controls

Security procedures

Authorization procedures

Refund processing times

Your transaction may be declined or delayed by your bank, card issuer, payment processor, or another financial institution.

14. Promotions, Specials, and Discounts

Promotions, discounts, coupons, and specials may be subject to:

Specific dates

Availability

Quantity limits

Minimum purchase requirements

Eligible items

Dine-in, pickup, or delivery restrictions

Other disclosed conditions

Promotions may not be combined unless expressly stated.

We may end or modify a promotion where permitted by law.

Any applicable restrictions will be communicated with the offer where reasonably necessary.

We do not intend to advertise a discount, price advantage, or promotion that does not actually exist. Utah law prohibits deceptive representations concerning price advantages and other consumer transactions.

15. Gift Cards

If Costa Del Sol offers gift cards or gift certificates, additional terms displayed at the time of purchase may apply.

Gift cards:

Have no cash value except where required by law.

Must be used according to their applicable terms.

May be subject to restrictions permitted by law.

Should be treated like cash if lost or stolen.

Any expiration dates, fees, or other limitations will be governed by applicable law.

16. Reservations

Where reservation functionality is available, submitting a reservation request does not necessarily guarantee seating unless confirmation is provided.

We may contact you regarding:

Reservation confirmation

Changes

Delays

Cancellations

Party size

Seating needs

Guests should notify us when they expect to arrive late or when their party size changes.

Reservation availability may change because of restaurant capacity and operational conditions.

17. Catering

Catering orders may be subject to separate terms concerning:

Deposits

Minimum order amounts

Delivery

Setup

Cancellation

Final guest counts

Payment deadlines

Menu substitutions

Any additional catering terms communicated during booking will apply to the applicable catering order.

18. Restaurant Hours

Restaurant hours displayed online are provided for convenience and may change.

Costa Del Sol may temporarily close, open late, close early, or modify service because of:

Holidays

Weather

Staffing

Maintenance

Private events

Emergency conditions

Equipment issues

Other operational reasons

We make reasonable efforts to keep online hours current.

19. Reviews and User-Submitted Content

If you submit a review, photograph, comment, feedback, testimonial, or other content directly to Costa Del Sol, you represent that you have the right to submit it.

You may not submit content that:

Is unlawful

Is fraudulent

Violates another person's intellectual property

Contains malicious software

Contains confidential information you have no right to disclose

Impersonates another person

We may remove content from portions of our website that we control where reasonably necessary.

Independent review platforms control content submitted directly to their platforms.

20. Intellectual Property

Unless otherwise indicated, content on this website is owned by Costa Del Sol or used with permission.

This may include:

Logos

Restaurant branding

Photographs

Videos

Website graphics

Menu designs

Written content

Website layouts

Promotional materials

You may view and use this content for personal, noncommercial purposes.

You may not reproduce, publish, distribute, modify, sell, commercially exploit, or falsely represent Costa Del Sol content as your own without authorization, except where permitted by law.

21. Third-Party Websites and Services

Our website may contain links or integrations involving third parties, including:

Google

Google Maps

Google Reviews

Social media platforms

Payment processors

Delivery services

Ordering providers

Reservation platforms

These services are independently operated.

Costa Del Sol is not responsible for the content, availability, privacy practices, or independent actions of third-party websites or platforms.

Your use of those services may also be subject to their separate terms and privacy policies.

22. Website Availability

We do not guarantee that the website will always operate without interruption.

The website may occasionally be unavailable because of:

Maintenance

Updates

Internet outages

Hosting problems

Security issues

Software errors

Third-party service outages

Events outside our reasonable control

We may modify, suspend, or discontinue website functionality when reasonably necessary.

23. Privacy

Your use of the website is also subject to our Privacy Policy.

Our Privacy Policy explains how personal information may be collected, used, disclosed, and protected.

The Privacy Policy should be read together with these Terms.

24. Accessibility

Costa Del Sol is committed to improving access to its website and restaurant services for individuals with disabilities.

Please review our Accessibility Statement for additional information and instructions for requesting accessibility assistance.

25. Electronic Transactions

Transactions and communications conducted electronically may have legal effect.

Utah's Uniform Electronic Transactions Act provides that a contract or record generally may not be denied legal effect solely because it exists electronically.

By intentionally submitting an online order or other electronic transaction through the website, you agree that the transaction may be completed electronically.

26. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its informational content are provided on an “as available” basis.

We do not warrant that:

The website will always be uninterrupted.

Every website error will immediately be corrected.

All third-party services will always be available.

Every device or browser will display the website identically.

This provision does not disclaim warranties, protections, or consumer rights that cannot legally be waived.

27. Limitation of Liability

To the fullest extent permitted by applicable law, Costa Del Sol will not be responsible for indirect, incidental, special, or consequential losses arising solely from website use, website interruptions, or independent third-party platforms.

This limitation does not exclude liability that cannot legally be excluded or limited.

Nothing in these Terms is intended to waive rights or remedies provided to consumers under applicable law or to exclude liability for conduct for which liability cannot legally be disclaimed.

28. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the website, violation of these Terms, or infringement of another person's rights.

This section does not apply where prohibited by law.

29. Fraud and Unauthorized Transactions

We reserve the right to review, reject, cancel, or investigate orders that reasonably appear to involve:

Fraud

Unauthorized payment methods

False information

Abusive activity

Attempts to exploit pricing or technical errors

We may cooperate with payment processors, banks, law enforcement, or other appropriate parties where reasonably necessary to address suspected fraud or unlawful activity.

30. Governing Law

These Terms are governed by applicable federal law and the laws of the State of Utah, without regard to conflict-of-law principles, except where another jurisdiction's laws must apply.

Nothing in this section deprives a consumer of protections that cannot legally be waived.

31. Disputes

If a dispute arises concerning the website or an online restaurant transaction, we encourage customers to contact Costa Del Sol first so the issue can be reviewed.

Nothing in these Terms prevents either party from pursuing legal rights or remedies available under applicable law.

I would not add a mandatory arbitration clause or class-action waiver from a generic Wix template without Costa Del Sol's attorney specifically approving it. Those clauses have significant legal consequences and need to be drafted and implemented correctly.

32. Severability

If a court or other authority determines that any portion of these Terms is invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

33. No Waiver

If Costa Del Sol does not immediately enforce a provision of these Terms, that does not necessarily waive the right to enforce that provision later.

34. Changes to These Terms

We may update these Terms periodically to reflect changes in:

Restaurant operations

Website functionality

Online ordering

Service providers

Business practices

Applicable law

The updated version will be posted on this page.

The “Last Updated” date at the top will indicate when the Terms were most recently revised.

Changes will apply prospectively as required by applicable law.
